Check if there's a restriction in place

An Article 179(14) Order will state how long it is in force (how long it lasts)

If an Article 179(14) Order or some other restriction is in place and has not expired, you likely need leave or permission to apply to the court before you can make an application.

If you are unsure, you should contact the Court Office and seek clarification of whether the restriction is in place and which court your should apply to. Court Office details are available here.  Having your case reference number will make the process easier.  It will be on the top right hand side of any order and court documents.

If there is no restriction preventing application for an Order in place, you can make an application to the family court using Form C1 and paying the application fee.

Be sure to note when the restriction expires

If there is a restriction on applying, you will need to ask the court’s permission before you can apply for an Order using a Form C2.
